Terms and Conditions

1. Who We Are

Assessly provides self-serve software tools intended to help British Columbia homeowners understand their property

assessment and prepare materials for a property tax assessment appeal. Assessly is a software product, not a law

firm, appraisal firm, or professional advisory service.

2. Not Professional or Legal Advice

Assessly is a self-serve tool. Nothing on the Site or in any package, report, or output generated through Assessly

constitutes:

  • Legal advice

  • Professional real estate appraisal

  • Tax advice

  • A guarantee of any particular outcome, including a reduction in your property’s assessed value

You are solely responsible for reviewing, verifying, and deciding whether and how to use any materials generated

through Assessly, including whether to file an appeal with BC Assessment or the Property Assessment Review Panel

(PARP). We strongly encourage you to consult a licensed professional (e.g., a real estate appraiser or lawyer) if you

require professional advice specific to your situation.

3. No Guarantee of Results

Property assessment appeals are decided by BC Assessment, PARP, or other applicable government bodies, not by

Assessly. We do not guarantee that using Assessly will result in a successful appeal, a reduced assessment,

or any specific outcome. Past results referenced anywhere on the Site (including testimonials) are not indicative of

future results and may not reflect a typical user’s experience.

4. Data Accuracy and Third-Party Sources

Assessly packages may incorporate comparable sales data and other property information obtained from third-party

data providers and public sources. While we take reasonable steps to use reliable sources, we do not warrant the

accuracy, completeness, or currency of any comparable sales data, valuation figures, or other information

provided through the Site. You are responsible for independently verifying any data before relying on it or submitting

it as part of an appeal.

5. Purchasing and Using Assessly

When you purchase an appeal package or other service through the Site, you agree to provide accurate and complete

information about yourself and your property. You are responsible for reviewing the generated materials before

submitting them to BC Assessment, PARP, or any other body, and for the accuracy of anything you submit.

6. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to use Assessly. If we offer account creation in

the future, you are responsible for maintaining the confidentiality of your login credentials and for all activity under

your account.

7. Acceptable Use

You agree not to:

  • Use the Site or Assessly’s outputs for any unlawful purpose or to submit fraudulent or knowingly false

information in a property tax appeal

  • Attempt to scrape, reverse-engineer, or extract Assessly’s underlying data pipeline, algorithms, or comparable

    sales database

  • Resell, redistribute, or sublicense Assessly-generated packages or underlying data to third parties without our

    written consent

  • Interfere with or disrupt the operation of the Site

8. Intellectual Property

All content on the Site — including text, design, graphics, logos, software, and the Assessly name and branding — is

owned by or licensed to Assessly and is protected by applicable intellectual property laws. You may not copy, modify,

or distribute any part of the Site without our prior written permission.

Any appeal package or report generated for you through Assessly is licensed to you for your personal, non-

commercial use in connection with your own property assessment appeal.

9. Fees and Payment

Prices for Assessly’s services are displayed on the Site at the time of purchase and are in Canadian dollars unless

otherwise stated. By completing a purchase, you authorize us (or our third-party payment processor) to charge your

payment method for the applicable fee

Refunds: Appeal packages are non-refundable once generated. See our Refund Policy for full details, including

exceptions for technical issues and orders cancelled before generation.

Price changes: We may change our pricing at any time. Changes will not affect packages already purchased.

10. Disclaimers

The site and all Assessly services and outputs are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

11. Limitation of Liability

To the fullest extent permitted by law, Assessly and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, arising from or related to your use of the site or any Assessly service — including any outcome (or lack thereof) of a property tax assessment appeal. Our total liability for any claim arising out of these terms or your use of Assessly shall not exceed the amount you paid to Assessly, if any, in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Assessly and its officers, employees, and agents from any claims, damages,

losses, or expenses (including reasonable legal fees) arising from your use of the Site, your violation of these Terms,

or any appeal materials you submit to BC Assessment, PARP, or any other body.

13. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your

personal information.

14. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the “Last

Updated” date above. Continued use of the Site after changes take effect constitutes acceptance of the revised

Terms.

15. Termination

We reserve the right to suspend or terminate your access to the Site or any Assessly service at our discretion,

including for violation of these Terms.

16. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable

therein, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the

courts of British Columbia.
